After I record a file, then try to save as an mp3, if I select VBR Recording with 144kps max , it fails

and produces a file of only 1kb!

If I use 160kbs as max, it records just fine ...

How can I prevent the 'Recording started' prompt from being saved when I record a file ?

I have tried to record prior to the file being recorded, but it still is recorded along with the file !
