Did you ever find an answer? I'm having the same problem. Ordered a new foot pedal. It worked really well for a day and now it doesn't work either.

have you figured this out? It was happening to me, so I ordered a new pedal. Worked perfectly for the first day and now it is doing the same thing Every fifth or sixth time that I lift my foot and put it back down, the recording doesn't start back up. Only thing that works is moving cursor to click on express scribe icon on the menu bar. This is slowing me down significantly.
